Types Of Construction Disputes

Disputes may arise in the middle of construction where there has been an alleged breach of contract by the builder (or contractor or subcontractor) or owner. Disputes may also result after completion if construction defects are discovered. Issues that may be discovered post-construction can include the following:

  • Drainage and roof issues
  • Fireplace issues
  • Engineering failures
  • Improperly installed air conditioners
  • Heating systems lacking proper load
  • Failure to use proper materials
  • Irregularities of any kind

Analysis Prior To Pursuing Construction Litigation

In every case, our firm performs a detailed cost-benefit analysis. We assess and analyze your case by looking at it from the outset. We examine proceedings from the contract stage through the point of dispute in order to provide a practical recommendation whether to proceed with construction litigation.

Based on your contract and current dispute, we may find it beneficial to seek out third-party experts for further assessment. If so, we will incorporate the experts’ analysis into our recommendation for proceeding.

Construction Litigation Representation

Our firm represents either side in construction disputes. If you are a builder or subcontractor, our representation may include filing a mechanic’s lien, or institution of a lawsuit or arbitration.

If you are a property owner who believes a mechanic’s lien was unjustly placed on your property, we may work to dissolve the lien or post bond to remove the lien from your property. Liens can be a serious detriment, even resulting in banks halting loans. Resolving your concern may lead to institution of a lawsuit or arbitration, although we always examine alternative dispute resolution options.

When a neighboring property has been damaged by construction or failure to clean up after construction, we represent parties in litigation to obtain compensation for the construction-related harm.
